1. Who we are

Datamotive Technologies Pvt. Ltd. ("Datamotive", "we", "us", "our") operates the website at datamotive.io and provides the Datamotive disaster recovery platform. This Privacy Policy explains how we collect, use, store, and share personal data when you visit our website or interact with us.

2. What data we collect and why

2.1 Contact and demo request forms

When you submit a demo request or contact form we collect: full name, work email address, company name, phone number (optional), job role (optional), and any message you include.

Purpose: To respond to your enquiry and provide product information.

Legal basis (GDPR): Consent (Article 6(1)(a)). You provide this by ticking the consent checkbox before submitting.

Retention: We retain your data for up to 24 months from the date of submission, or until you request deletion, whichever is sooner.

2.2 Newsletter subscriptions

When you subscribe to our newsletter we collect your email address.

Purpose: To send you DR insights, product updates, and industry news.

Legal basis (GDPR): Consent (Article 6(1)(a)).

Retention: Until you unsubscribe. You can unsubscribe at any time using the link in any email or by contacting us.

2.3 Website analytics

If you accept analytics cookies, we use Vercel Speed Insights to collect anonymised page performance data (Core Web Vitals, load times, device type). This data is processed by Vercel, Inc. on infrastructure in the United States.

Legal basis (GDPR): Consent (Article 6(1)(a)).

Retention: 30 days on Vercel's servers per their data retention policy.

2.4 Google Fonts

If you accept analytics cookies, Google Fonts are loaded from Google's servers (fonts.googleapis.com). Your IP address and browser user-agent are sent to Google. If you reject or have not yet decided, we use system fonts instead.

2.5 TCO Calculator session data

The TCO Calculator stores currency exchange rates in your browser's sessionStorage under the key dm_fx_cache for up to one hour. This data never leaves your device. It is deleted automatically when you close the browser tab.

Legal basis (GDPR): Legitimate interest in providing a functional tool (Article 6(1)(f)).

2.6 Cookie consent record

We store your cookie consent choice in your browser's localStorage under the key dm_cookie_consent so that we do not ask you again on subsequent visits. It records your choice (accepted/rejected), timestamp, and policy version. No personal identifiers are included.

Legal basis (GDPR): Legitimate interest in complying with our legal obligations (Article 6(1)(c) / (f)).

3. Who we share data with

We do not sell personal data to third parties.

Transfers to the United States are made under Standard Contractual Clauses (SCCs) or, where applicable, the EU-US Data Privacy Framework.

4. International data transfers

Datamotive is headquartered in India and has operations in the United States. Data you provide may be transferred to and processed in the United States or other countries where our service providers operate. We ensure appropriate safeguards are in place for all such transfers in accordance with GDPR Chapter V (Standard Contractual Clauses) and the Indian Digital Personal Data Protection Act 2023 (DPDP Act).

5. Your rights

Depending on your location, you have the following rights:

  • Right to access - request a copy of the personal data we hold about you.
  • Right to rectification - ask us to correct inaccurate data.
  • Right to erasure ("right to be forgotten") - request deletion of your data.
  • Right to restrict processing - ask us to limit how we use your data.
  • Right to data portability - receive your data in a machine-readable format.
  • Right to object - object to processing based on legitimate interest.
  • Right to withdraw consent - you can withdraw consent at any time without affecting the lawfulness of prior processing.

You also have the right to lodge a complaint with your local supervisory authority. In the EU, this is your national Data Protection Authority. In India, this is the Data Protection Board of India.

8. Data security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure. Our platform is SOC 2 Type II certified. However, no internet transmission is completely secure and we cannot absolute security.

9. Children's privacy

Our website is not directed at children under 16. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us at privacy@datamotive.io and we will delete it promptly.

10. Changes to this policy

We may update this Privacy Policy periodically. When we do, we will update the effective date above and, if changes are material, display a notice on the website. Continued use of the website after a policy update constitutes acceptance of the revised policy.
